Confirmation of an order implies full and unconditional acceptance of these General Terms and Conditions of Sale.
1 – Subject
The purpose of these Terms and Conditions is to set out the rights and obligations of Aurélie Rocheta and her customers in relation to the sale of original artworks offered on the website www.aurelierocheta.com.
The artworks offered for sale are original creations by Aurélie Rocheta.
Each artwork is unique or available as a limited edition where this is specified in its description.
2 – Presentation of the artworks
The photographs and descriptions of the artworks featured on the website have been produced with the utmost care to enable customers to fully appreciate the characteristics of each creation.
However, colours may vary slightly depending on the settings of the screens used.
The dimensions, techniques, materials and other details relating to each artwork are set out in its description.
Artworks marked as sold or out of stock can no longer be ordered.
3 – Price
The photographs and descriptions of the works featured on the website have been produced with the utmost care to enable customers to fully appreciate the characteristics of each creation.
However, colours may vary slightly depending on the settings of the screens used.
The dimensions, techniques, materials and other details relating to each work are set out in its description.
4 – Order
The customer selects the artwork they wish to purchase and follows the ordering process set out on the website.
Before final confirmation, the customer checks that the information provided is correct.
The order is deemed to have been accepted once payment has been confirmed.
A confirmation email is sent to the customer once the order has been confirmed.
Aurélie Rocheta reserves the right to refuse or cancel an order in the event of a dispute relating to a previous order, an obvious pricing error or the exceptional unavailability of the artwork.
5 – Payment
Payment for orders is made online via the secure payment methods available on the website:
– Stripe;
– PayPal.
Aurélie Rocheta never stores any bank details.
Payment is due in full at the time of ordering.
The order is only prepared once payment has been received.
6 – Delivery
Artworks are dispatched to the address provided by the customer when placing the order.
Delivery times are given as a guide only and may vary depending on the carrier, the destination and the terms of transport.
Aurélie Rocheta undertakes to pack the artworks with care to ensure they are protected during transit.
Should any damage be noted on receipt, the customer must lodge the necessary complaints with the carrier and contact Aurélie Rocheta as soon as possible.
7 – Reception of the artwork
Customers are asked to check the condition of the artwork upon receipt.
Any issues regarding the delivery or the condition of the artwork must be reported promptly by email to:

along with, if necessary, photographs showing the problem.
8 – Right of withdrawal
In accordance with the provisions of Article L221-28 of the Consumer Code, the right of withdrawal does not apply to works made to measure or personalised at the customer’s request.
For original works available for sale on the website, the customer is entitled to the right of withdrawal provided for by the regulations in force, unless otherwise provided for by law.
The customer may contact Aurélie Rocheta before placing any order to obtain further details regarding the applicable terms and conditions.
9 – Transfer of copyright
The purchase of an original artwork entails only the transfer of physical ownership of the artwork.
The copyright attached to the artwork remains the exclusive property of Aurélie Rocheta in accordance with the Intellectual Property Code.
Unless prior written authorisation has been granted, the purchaser has no right to reproduce, display or commercially exploit the work.
10 – Liability
Aurélie Rocheta cannot be held liable for any damage resulting from misuse or unsuitable storage conditions of the artwork after delivery.
She undertakes, however, to supply artworks that comply with the descriptions provided on the website.
11 – Personal data
The personal data collected when an order is placed is necessary for processing and tracking that order.
It is processed in accordance with the Privacy Policy available on the website.
The customer has the rights set out in the applicable regulations regarding their personal data.
12 – Intellectual property of the website
All material on the website www.aurelierocheta.com (text, photographs, artwork, graphics, logo and content) is protected by the Intellectual Property Code.
Any reproduction or use without prior authorisation is prohibited.
13 – Governing law and dispute resolution
These General Terms and Conditions of Sale are governed by French law.
In the event of any difficulty or dispute relating to an order, the customer is invited to seek an amicable solution with Aurélie Rocheta before taking any legal action.
In accordance with the provisions of the Consumer Code, the consumer may also make use of a consumer mediation scheme free of charge.
In the absence of an amicable agreement, the competent courts shall be those designated in accordance with the applicable rules of ordinary law.
